Advertising Lists of Properties For Sale Must Contain the Name of the Brokerage
FACTS: A licensee regularly sends a list of properties for sale to a neighborhood he markets to.
ISSUE: Does the licensee have to display the name of each listing broker?
ANSWER: Yes.
DISCUSSION:
“[A] licensee who advertises a property that is the subject of another person’s real estate employment agreement shall display the name of the listing broker in a clear and prominent manner.” A.A.C. R4-28-502(F). Therefore, the name of each broker must be displayed in a clear and prominent manner.
