FACTS: The buyer and seller entered into a purchase contract in which the buyer is applying for a Veteran’s Administration (VA) loan.  The VA appraisal identified several repairs that needed to be made to meet the VA Minimum Property Requirements (MPR). 

ISSUE: Is the seller obligated to make the repairs identified in the VA appraisal? 

ANSWER: No. 

DISCUSSION:

The seller is not obligated to make the repairs identified in the VA appraisal.  If the seller does not agree to make the repairs, the buyer is entitled to cancel the contract or the buyer can request an MPR waiver, which must be approved by the VA and the mortgage lender.
