FACTS: Three siblings own the property.  Two of the siblings want to sell the property, but the third sibling does not want to sell. 

ISSUE: What are the options to resolve this dispute over the sale of the property?

DISCUSSION:

The two siblings that want to sell the property can file a partition action to ask the Court to divide or partition the property by ordering the property to be sold and the net proceeds divided between the owners in proportion to their ownership interests. Independent legal counsel should be consulted regarding the advisability of a partition action.
